These three water rights are senior in right to the Skagit Instream Flow Rule and therefore are not subject to interruption when regulated flows are not being met.</p><p style='margin-top:0px; margin-bottom:1.5rem; font-family:&quot;Avenir Next W01&quot;, &quot;Avenir Next W00&quot;, &quot;Avenir Next&quot;, Avenir, &quot;Helvetica Neue&quot;, sans-serif; font-size:16px;'>The boundary is based on a groundwater assessment in the Nookachamps Creek sub basin downstream of the former Big Lake Water Association well field. This groundwater assessment was based in part on the United States Geologic Survey findings in “<span style='font-family:inherit; font-style:italic;'>Hydrogeologic Framework, Groundwater</span> <span style='font-family:inherit; font-style:italic;'>Movement, and Water Budget in Tributary SubBasins and Vicinity, Lower Skagit River Basin, Skagit and Snohomish Counties, WA USGS Scientific</span> <span style='font-family:inherit; font-style:italic;'>Investigations Report 2009-5270</span>” and partly on Ecology’s assessment of groundwater occurrence, elevations, and flow directions based on well log data.</p><p style='margin-top:0px; margin-bottom:1.5rem; font-family:&quot;Avenir Next W01&quot;, &quot;Avenir Next W00&quot;, &quot;Avenir Next&quot;, Avenir, &quot;Helvetica Neue&quot;, sans-serif; font-size:16px;'>The western extent of this mitigation boundary was set to the city limits of Mount Vernon. This information provides only generalized groundwater flow directions and should not be relied upon for detailed groundwater characteristics at any one location within the designated area. This analysis cannot ensure the uniformity of data gathering techniques and the resulting interpretation of the data, since well log data was collected by individual drillers. This includes the assumption that water level data taken at the time of well construction actually represent static water levels. Furthermore, averaged monthly USGS water elevation data was used alongside the one-time well log data collected by Ecology. These averaged data points may not represent a good correlation with synoptic or one-time water measurements. However, groundwater flow directions were drawn between data points gathered from same source if possible to offset this potential problem. Finally Ecology’s use of one-time water depth measurements from across a decade introduces the potential problem of seasonal and long-term groundwater fluctuations which might skew the data.
