The Port of Skagit has owned and </font><font style='font-family:inherit;'>operated the airport since 1965 and asserts that it has obtained avigation </font><font style='font-family:inherit;'>easements by prescription over property surrounding the Skagit Regional </font><font style='font-family:inherit;'>Airport.</font></p><p style='margin:0in 0in 3pt;'><font style='font-family:inherit;'><font style='font-family:inherit;'></font>(iii) State law requires the County to protect public use airports from incompatible land uses through comprehensive planning and development regulations (RCW 36.70.547 and 36.70A.510).</font></p><font style='font-family:inherit;'><p style='margin:0in 0in 3pt;'><font style='font-family:inherit;'></font></p><font style='font-family:inherit;'><p style='margin:0in 0in 3pt;'><font style='font-family:inherit;'>(iv) In 1999, the Washington State Department of Transportation (WSDOT), </font><font style='font-family:inherit;'>Aviation Division, adopted guidelines that provided technical information and </font><font style='font-family:inherit;'>policy recommendations regarding airport land use compatibility. Skagit </font><font style='font-family:inherit;'>County used that document, together with information from the California </font><font style='font-family:inherit;'>State Department of Transportation Airport Land Use Planning Handbook </font><font style='font-family:inherit;'>(1993), and information specific to the Skagit Regional Airport, to prepare the </font><font style='font-family:inherit;'>Skagit Regional Airport Land Use Compatibility Study (May 2000) that was </font><font style='font-family:inherit;'>the basis for the first version of this Airport Environs Overlay code. In 2011, </font><font style='font-family:inherit;'>WSDOT issued an updated Airports and Compatible Land Use Guidebook. The </font><font style='font-family:inherit;'>2011 guidance recommends additional compatibility criteria within six </font><font style='font-family:inherit;'>Compatibility Zones surrounding the airport.</font></p><p style='margin:0in 0in 3pt;'></p><p style='margin:0in 0in 3pt;'><font style='font-family:inherit;'>(v) Where airport operations exist side-by-side with other development, or where low-flying air traffic overflies other development, airport operations <font size='3' style='font-family:inherit;'><font size='3' style='font-family:inherit;'>are frequently the subject of nuisance complaints. As a result, some airports have been forced to cease or curtail operations.
