snippet: This boundary was created for the purpose of delineating an area where current and future property owners can acquire mitigation credits to offset consumptive use of water that was ruled in violation of the Skagit Instream Flow Rule by the WA State Supreme Court in 2013. In 2013 the Department of Ecology acquired three water rights from the former Big Lake Water Association and placed them in trust for the use of stream flow augmentation and mitigation purposes. These three water rights are senior in right to the Skagit Instream Flow Rule and therefore are not subject to interruption when regulated flows are not being met. The boundary is based on a groundwater assessment in the Nookachamps Creek sub basin downstream of the former Big Lake Water Association well field. This groundwater assessment was based in part on the United States Geologic Survey findings in “Hydrogeologic Framework, Groundwater Movement, and Water Budget in Tributary SubBasins and Vicinity, Lower Skagit River Basin, Skagit and Snohomish Counties, WA USGS Scientific Investigations Report 2009-5270” and partly on Ecology’s assessment of groundwater occurrence, elevations, and flow directions based on well log data. The western extent of this mitigation boundary was set to the city limits of Mount Vernon. The eastern extent was set to the designated boundary between the Nookachamps Creek sub basin and the East Fork Nookachamps sub basin.
